Wax seal is Maker’s Mark’s

LOUISVILLE (Kentucky) – THE dripping red wax seal on a bottle of Maker’s Mark bourbon is not only distinctive, it now legally belongs to the Kentucky company.

A federal judge issued an injunction on Friday preventing a rival liquor company from using a dripping wax seal, ending a seven-year legal battle over the bottle topper.

The ruling by US District Judge John G. Heyburn II comes in a lawsuit Maker’s Mark filed against London-based Diageo North America and Casa Cuervo of Mexico over the Kentucky company’s trademark on the wax seal.

Cuervo used a dripping red wax seal on a special bottle of its Reserva tequila, which was distributed by Diageo.

Judge Heyburn’s ruling barred the companies from using the seal, but did not award damages to Maker’s Mark. — AP
